Terms of Service (Swimming Lessons)

These terms of service outline the terms and conditions for the services (swimming lessons) rendered by SwimEasy.net.

You're required to read through this Terms of Service if you're going to apply for this service (attend swimming lessons). By submitting the Application Form or Registration Form, you're hereby understand and agree to this Terms of Service.

All services, which are provided by SwimEasy.net, are not transferable from one person to another.

1. Lesson will be conducted once a week.
2. 5th week break. Only 4 lessons will be conducted on months with 5 weeks. The 5th week will be cancelled unless changed by the instructor.
3. No lesson if student's scheduled lesson falls on public holiday, Chinese New Year Eve and the 3rd to 5th day after the Chinese New Year. No make-up lesson, no compensation and no refund.
4. No make-up lesson, no compensation and no refund if the student is absent for any reason unless due to sickness with a valid medical certificate from the doctor.
5. No make-up lesson, no compensation and no refund when the student is late for lesson, withdraw from the course, refuses to swim or any other behavior problem which is beyond the instructor's control.
6. We reserve the right to postpone the start date of class in the event if the class size does not meet the minimum capacity and requirements.
7. We reserve the right to merge different classes of similar level if class size does not meet the minimum capacity and requirements.
8. Student who missed 4 lessons or more will be removed from the class or slots will be taken over by other students.
9. All payments should be made before the first week of the month or otherwise as stated.
10. Lesson that starts other than in the first week of the month will be pro-rated as per lesson or per week for new applicants only.
11. All payments should be made by bank transfer or PayNow.
12. A month's fee is still chargeable if you never give us two weeks in advance notice before the new month starts about the withdrawal/termination from our service.

1. Last minute cancellation will still be counted as a lesson taken unless instructor is informed 1 day in advanced.
2. All 4 lessons have to be consumed within 30 days starting from the first lesson. Any outstanding lessons will be forfeited with no compensation.
3. All make-up lessons (for the whole group) should be arranged in favour to the instructor's availability.
4. All payments should be made by bank transfer or PayNow.

• If your scheduled lesson falls on Public Holiday, Chinese New Year Eve and the 3rd to 7th day after the Chinese New Year.
• When the pool is closed due to bad weather or whatsoever such as lightning and heavy rain etc.
• When the instructor is ill or unavailable, we will try our best to inform you as soon as possible and that particular lesson's fee will be refunded accordingly unless changed by the instructor.

• Late for lesson.
• When the student refuses to swim or any other behavior problem which is beyond the instructor's control.
• Absent for any reason unless due to sickness with a valid medical certificate from the doctor.
• When the pool is closed due to bad weather or whatsoever such as lightning and heavy rain etc. before or during the lesson.
• If your scheduled lesson falls on Public Holiday, Chinese New Year Eve and the 3rd to 7th day after the Chinese New Year.

• The instructor or the pool authority reserve the rights to cancel the swimming lesson in the event of bad weather.
• Due to unforseen circumstances, swimming lesson will be counted in the event of bad weather conditions.

Under the Personal Data Protection Act (PDPA), photograph(s) and video(s) of an individual are considered personal data. This is to notify students and/or parents/guardians that photograph(s) or video(s) of students and/or parents/guardians may be captured during related activities and events such as swimming class lessons, swim camps, swim tests, etc. We may use and publish such photographs and/or video recordings in our publications (if any), website, social media channels, and other communication channels besides the use of such video(s) for video analysis. However, these photographs and/or videos will not be released to any third party without the individual's consent.

For public swimming pools
• You are required to purchase your own entrance ticket.

For private swimming pools
• You are required to pay for any deposits and/or fees (i.e. usage of pool, entrance fee, parking fee) if required by the facilities management for the instructor.
• You are strongly advised to check on their condo terms and requirements before hiring a private swimming instructor.

We will not be held accountable for any claims or costs associated with claims that arise from any injury, damage or loss of life that may occur in classes or lessons.
